The Gap Between "We're Compliant" and Actually Being Compliant

GDPR turned eight this year. The AI Act is now in force. And most AI systems we audit still fail basic data protection requirements.

Not because the teams are careless. Because the regulatory landscape has shifted faster than anyone's compliance documentation could keep up. The AI system you deployed in 2023 with a clean DPIA might be non-compliant today — not because you changed anything, but because the rules around it changed.

We've run compliance audits on AI systems across healthcare, fintech, and enterprise SaaS. The pattern is consistent: organizations that thought they were covered discover gaps once they map current requirements against their actual architecture. This checklist is what we use internally. Now it's yours.


What Changed: The 2026 Regulatory Reality

If you last checked your GDPR posture in 2024, here's what you missed.

The AI Act timeline is real now. It entered into force in August 2024. Prohibited practices took effect in February 2025. Transparency obligations and high-risk system requirements are phasing in through 2026. If your AI system falls under high-risk classification — and more systems do than you'd expect — you need conformity assessments, technical documentation, and quality management systems.

GDPR enforcement specifically targeting AI has escalated. Data protection authorities across Europe are issuing larger fines and more detailed guidance on AI-specific processing. The days of vague "we process data using automated means" privacy notices are over.

DORA adds a layer for financial services. If your AI system operates in financial services, the Digital Operational Resilience Act imposes additional ICT risk management requirements that intersect with both GDPR and the AI Act. We covered this in detail in our DORA + AI Act analysis.

National implementations are diverging. Germany's BfDI has published specific AI processing guidance. France's CNIL released its AI framework with practical enforcement priorities. These aren't contradictions, but the nuances matter — especially if you operate across multiple EU member states.


The Checklist

Use this as a gap assessment. Every item is a yes-or-no question. If you can't confidently answer "yes," you have work to do.


Data Processing Fundamentals

Do you have a documented lawful basis for every AI processing activity?

Consent, legitimate interest, contractual necessity — each requires different documentation and creates different obligations. Legitimate interest requires a balancing test. Consent must be freely given, specific, informed, and unambiguous. "We need it for the AI" is not a lawful basis.

Are you feeding the model only the data it actually needs?

Data minimization isn't optional. If your customer support AI ingests full customer profiles when it only needs order history, you're collecting more personal data than necessary. Audit what goes into prompts, what gets stored in context, and what persists in conversation histories.

Is model output used only for the purposes you stated?

Purpose limitation means the data collected for customer support can't quietly start feeding a marketing recommendation engine. Every new use case for AI-processed personal data needs its own lawful basis assessment.

Do you have retention policies for training data, inference logs, and conversation histories?

Storage limitation requires that personal data isn't kept longer than necessary. This includes prompt logs, model responses, cached outputs, and vector database entries. "We might need it later" is not a retention policy.


Transparency and Explainability

Can you explain to a non-technical person what your AI does with their data?

Article 13 and 14 require meaningful information about the logic involved in automated processing. "We use AI to improve your experience" fails this test. You need to describe the processing in terms the data subject can actually understand.

Are your privacy notices updated to cover AI processing?

Generic privacy policies written before you deployed AI are insufficient. You need specific disclosures about AI processing, including the types of data processed, the purpose, the logic involved, and the significance and envisaged consequences for the data subject.

Do you have meaningful human oversight for automated decisions?

Article 22 restricts decisions based solely on automated processing that produce legal or similarly significant effects. If your AI approves loans, screens job applications, or determines insurance eligibility, you need genuine human review — not rubber-stamping.

Can a data subject get an explanation when AI affects them?

When someone asks why the AI made a particular decision about them, you need an answer. Not the model's weights — a meaningful explanation of the factors involved and how they influenced the outcome.


Data Subject Rights

Can you retrieve all data processed by AI for a specific person?

Right to access means you need to find and return everything: training data, inference logs, embeddings, cached responses, data in vector databases. If personal data is embedded in a vector representation, you need to know it's there and be able to identify it.

Can you actually delete someone's data from your AI system?

Right to erasure is where most AI systems break down. Deleting a database record is straightforward. Deleting someone's data from fine-tuned model weights, vector database embeddings, cached inference results, and conversation logs across distributed systems — that's an architecture problem. More on this below.

Can you correct errors the AI makes about individuals?

Right to rectification applies to AI outputs too. If your system generates incorrect information about a data subject and stores or acts on it, you need a mechanism to correct both the stored data and any downstream effects.

Can users opt out of AI processing entirely?

Right to object requires that you provide a mechanism for data subjects to say "don't process my data with AI" and that you actually honor it. This means your data pipeline needs a bypass path that doesn't route through AI processing.


Technical Safeguards

Have you completed a Data Protection Impact Assessment for your AI system?

DPIAs are mandatory for processing that is likely to result in high risk to individuals. AI processing of personal data almost always qualifies. Your DPIA should cover the specific risks introduced by AI — bias, hallucination, re-identification, unintended data retention — not just generic security risks.

Is privacy by design documented in your architecture decisions?

Privacy architecture isn't retroactive. Article 25 requires that data protection is integrated into the design of your processing activities. Document the architectural decisions you made to protect personal data, and document why you chose one approach over alternatives.

Is personal data encrypted at rest and in transit throughout the AI pipeline?

This includes model inputs, model outputs, stored conversation histories, vector database contents, cached results, and log files. If personal data passes through any component unencrypted — including during preprocessing or postprocessing — you have a gap.

Who can see model inputs and outputs, and is that access controlled and logged?

Access controls need to cover the entire AI pipeline: who can submit prompts containing personal data, who can view responses, who can access stored conversations, who can query the vector database, and who has access to model training data. Every access should generate an audit log entry.


AI Act Specific Requirements (2026)

Have you classified your AI system's risk level?

The AI Act defines four risk categories: unacceptable, high, limited, and minimal. High-risk systems include AI used in employment, creditworthiness, law enforcement, education, and critical infrastructure. If you haven't formally classified your system, start here.

If high-risk: do you have conformity assessment documentation?

High-risk AI systems require technical documentation covering design, development, testing, and monitoring. You need a quality management system, a risk management system, and records of post-market monitoring. This isn't a one-time exercise — it's ongoing.

Are you meeting transparency obligations for AI-generated content?

Systems that generate text, images, audio, or video must be designed so that outputs are marked as AI-generated in a machine-readable way. If your system interacts directly with people, they must be informed they're interacting with AI.

Have you checked against prohibited practices?

Social scoring, real-time biometric identification in public spaces (with narrow exceptions), manipulation of vulnerable groups, and inferring emotions in workplaces and schools are prohibited. If any part of your system touches these areas, stop and get legal advice before proceeding.


The Hard Parts Nobody Warns You About

The checklist gives you the requirements. Here's where implementation actually gets difficult.

Deleting Data from Fine-Tuned Models

When a data subject exercises their right to erasure, you need to remove their personal data from your AI system. If that data was used to fine-tune a model, the data is encoded in the model weights. You can't surgically remove one person's data from a neural network.

Your options: retrain the model without that person's data (expensive, time-consuming), use machine unlearning techniques (still experimental, no regulatory precedent for adequacy), or don't fine-tune on personal data in the first place (the approach we recommend). Design your data preparation pipeline with erasure in mind from day one.

Cross-Border Transfers with US AI APIs

If you're sending personal data to OpenAI, Anthropic, Google, or any US-based AI provider, you're making a cross-border data transfer. The EU-US Data Privacy Framework covers some scenarios, but not all providers are certified, and not all data categories are covered. Standard Contractual Clauses remain necessary for many configurations, and you need a Transfer Impact Assessment documenting why the transfer is safe.

Swiss-based processing avoids this complexity entirely. Switzerland has an EU adequacy decision, and keeping data within Swiss or EU infrastructure eliminates the transfer question. This is one reason organizations choose Swiss-based AI compliance partners for sensitive workloads.

The Vendor Responsibility Problem

When you use a third-party AI API, who's the controller and who's the processor? It depends on the specifics, and getting it wrong has consequences. If you're a joint controller with your AI vendor, you share liability for GDPR violations — including violations that happen on their infrastructure, outside your visibility.

Review your vendor agreements carefully. Data Processing Agreements should specify the roles, the scope of processing, sub-processor chains, and what happens to data when the contract ends. Vague agreements create joint controller risk whether you intended it or not.

The Legitimate Interest Trap

Legitimate interest is the most flexible lawful basis — and the most abused. Using it for AI processing requires a three-part balancing test: is the interest legitimate, is the processing necessary for that interest, and do the individual's rights override it? Many organizations skip the balancing test or conduct it superficially. Regulators have started rejecting legitimate interest claims for AI processing that could easily have been covered by consent.


What Compliant Architecture Actually Looks Like

Compliance isn't a document. It's how the system is built.

PII detection and classification before data enters the AI pipeline. Every piece of data gets classified before it reaches a model. Personal data gets tagged, tracked, and routed through protected processing paths. Non-personal data flows freely. This classification layer is the foundation of everything else.

Purpose-bound processing with automatic lifecycle management. Data processed for customer support stays in the customer support pipeline. Retention policies execute automatically — no manual cleanup, no "we'll get to it." When the retention period expires, the data is deleted across all stores, including vector databases and caches.

Consent management that works with AI workflows. If consent is your lawful basis, your consent records need to connect to your AI processing pipeline. When someone withdraws consent, the pipeline needs to stop processing their data immediately, not on the next batch run.

Regular DPIA reviews as the system evolves. Your DPIA from launch day doesn't cover the features you added six months later. Every significant change to how your AI system processes personal data triggers a DPIA review. Automate the triggers so reviews happen when they should, not when someone remembers.


Where to Start

If this checklist surfaced gaps — and for most organizations, it will — prioritize by risk. Data subject rights failures and missing DPIAs are the most common enforcement triggers. Transparency gaps are the most common complaint triggers.
